The following Terms and Conditions apply to your stay at Mobys Beachside Retreat

GENERAL:
Upon paying a booking deposit, you agree to these terms and conditions.
Terms & Conditions below are for bookings made directly with Mobys Beachside Retreat. These terms and conditions may be updated from time to time and are subject to change at our complete discretion without further notice to you.

BOOKINGS:
Bookings can be made directly with Mobys Beachside Retreat via phone 02 6591 0000 or via our online booking button at www.mobys.com.au

Bookings may only be made by persons who are aged 18 years or older. Any Persons under 18 years of age must be accompanied by a parent or guardian.
Reservations made directly with Mobys Beachside Retreat are subject to availability and actual pricing at the time of booking. All quotes provided via email are valid for 24hrs only. Any agreed prices and booking details will be confirmed in a confirmation email.
No bookings or rates are guaranteed more than 12 months in advance

DEPOSITS:
Pre-payment for the first night of any accommodation booking is required to confirm the booking. A booking deposit can be paid by:

  1. Visa credit/debit card
  2. Mastercard credit/debit card
  3. bank transfer into our Mobys Trust Account

Bank transfers into our trust account must be received within 7 days of making a reservation.

CREDIT CARD FEES:
All credit/debit card payments made to Mobys Beachside Retreat will incur a 1% non-refundable credit card service fee

CANCELLATION DUE TO NON-PAYMENT OF DEPOSIT:
Credit Card: If the credit card provided by the guest declines, the guest will be notified by email or SMS. If the guest fails to provide a deposit within 7 days of making a booking, the booking will be cancelled Bank
Transfer: If transferred funds are not received and not present on our trust account statement within 7 days of making a booking, the booking will be cancelled

PAY ON ARRIVAL POLICY:
The balance of any accommodation must be settled in advance or on arrival to Mobys Beachside Retreat. Access to accommodation will not be issued until payment in full has been received.
Payment can be paid by:

  1. Visa credit/debit card
  2. Mastercard credit/debit card

CREDIT CARD FOR INCIDENTAL CHARGES:
Regardless of payment type a physical and valid Visa or Mastercard Credit/debit card must be presented on arrival. The card details will be retained on file by Mobys Beachside Retreat for a period of 14 days. This card will be used to cover the cost of any incidental charges including restaurant charges and any damages that may occur.

IDENTIFICATION:
The guest will be required to show ID on arrival if requested Acceptable forms of ID include:

  1. passport
  2. Australian Drivers Licence
  3. NSW Government Proof of age card
  4. NSW Photo card

CHECK-IN:
Standard check- in time is 3.00pm. ID is required and the ID must match the details of the booked guest.
The guest must contact us in writing if they wish to authorise additional persons to collect the keys and sign the registration card on their behalf .

LATE ARRIVALS:
Guests arriving outside reception hours (after 5pm) must contact Mobys Beachside Retreat prior to 5pm to arrange collection of their keys.
The balance of any accommodation charges must be paid over the phone with a Visa or Mastercard credit card/debit card.
Arrangements for after hours key collection will then be disclosed to the guest.
The guest is required to formally sign in at reception the following day, at their earliest convenience,

CHECK OUT:
Standard check-out time is 10.00am. Late checkouts are available upon request. Please contact reception to check availability. Additional fees may be applied. A late check-out fee may apply if the property is not vacated prior to the set check-out time

FAILURE TO CHECK OUT:
An additional night’s fee is applicable if no late check out has been arranged and approved by management AND the guest fails to check out by 12 noon AND the guest is non contactable. If the resort is fully booked and expecting another guest Mobys management reserves the right to remove the guests belongings and clean the beach house. Perishable belongings will be disposed of and non-perishable belongings will be kept for a period of 30 days before being disposed of or donated to good-will. Locksmith fees may be passed onto the guest as an incidental charge if the locks require changing.

EARLY CHECK-OUT:
No Refunds will be given if the guest decides to check out prior to their scheduled departure date

Payments and Cancellations/Modifications

When you make your reservation to stay with us at Mobys, we kindly request payment for the first night of your stay upfront as a booking deposit.
Payments can be made via EFTPOS, Visa, Mastercard or direct deposit. Please note: a 1% credit card surcharge applies. Please refer to our following policies regarding deposits, payments, modifications, and cancellations:

Booking and Payment Policy (Excluding Christmas Holidays):

Booking Deposit: A deposit equal to the cost of the first night of your stay is required at the time of booking to secure your reservation.

Cancellations: If you cancel your booking more than 14 days prior to arrival, your deposit (minus any credit card surcharges) will be refunded. If you cancel your booking less than 14 days prior to arrival your booking deposit is non-refundable

Balance Payment: The remaining balance of your stay is due on or prior to arrival.

Booking Modifications: Modifications to your reservation can be made more than 14 days prior to arrival, subject to, availability and compliance with the minimum night requirement.

Within 14 days of arrival or during your stay you may add extra nights (subject to availability) but cannot reduce the number of nights in your booking.

Booking and Payment Policy for NSW Public School Christmas Holiday Period:

Booking Deposit: A deposit equal to the cost of the first night of your stay is required to secure your reservation.

Cancellations Before 1st November: If you cancel your booking prior to 1st November, your deposit (minus any credit card surcharges) will be refunded.

Balance Payment: The remaining balance of your stay, which becomes non-refundable is due on or before 1st November

Bookings Made After November 1st: A Full non-refundable payment for the total cost of your booking is required at the time of reservation.

Booking Modifications: Modifications to your reservation can be made more than 14 days prior to arrival, subject to, availability and compliance with the minimum night requirement.

Within 14 days of arrival or during your stay you may add extra nights (subject to availability) but cannot reduce the number of nights in your booking.

Keys will not be issued if payment for accommodation has not been settled in full

No refunds or travel credits will be issued if you vacate the resort prior to your scheduled departure date.

REFUNDS:
Any refunds will be refunded back onto the same credit/debit card that was used to process the deposit. If the credit card has expired or is not longer valid alternate credit card details or bank deposit details must be provided in writing.

Refunds can take up to 14 working days to be processed

GUESTS AND VISITORS:
Bedding is provided for up to 2 guests in a one bedroom beach house 4 guests in a two bedroom beach house 6 guests in a three bedroom beach house Up to 2 additional guests may stay overnight in each beach house in existing bedding only (ie: infants or small children with their own cot/bedding) No additional rollaway beds or sofa beds are available for hire. Tents/Swags/hammocks etc. cannot be erected on the property. Lodging in Motorhomes, caravans or any other type of vehicle with bedding in the resort is prohibited.
Visitors are welcome to visit you in your beach house providing they do not compromise the comfort and enjoyment of any other guest staying and/or cause excess noise that is likely to disturb another guest In the resort. Management reserves the right to ask any visitors to vacate the resort at any time.
Visitors may not use the swimming pool or other resort facilities or bring pets into the resort
The guest will be charged an amount at a rate determined by Mobys Beachside Retreat for any damage caused by a visitor of that guest.

CHILD POLICY:
Children of all ages are welcome. As the parents or guardians of children you are personally and legally responsible for and must supervise them at all times. Children are permitted to ride their bikes, scooters and skateboards around the resort during daylight hours. Please ensure they ride in the direction of traffic and observe the speed limit posted.

NO PARTY POLICY:
Mobys Beachside Retreat has a zero tolerance no party policy. In the interest of quiet enjoyment and respect for all guests at Mobys Beachside Retreat, a NO party policy applies to all guests staying at the property and their visitors. All guests are expected to be respectful of all other guests at all times, and to particularly minimise noise between 10pm and 8am. In the event that any room/guest is identified as creating excessive noise likely to disturb any other guest in the resort, management reserves the right to caution the guest about the excess noise. If the problem is not rectified the guest may be charged a call out fee of $200. Management at Mobys Beachside Retreat also reserves the right to evict all occupants of the beach house if the excess noise continues. The police will be notified, and the registered guests will be required to pay for any expenses resulting from additional cleaning of the room, replacement of any furniture/fixture/fitting breakage, as well as for any required repairs.

FEES CHARGEABLE TO GUESTS ACCOUNT INCLUDE, AND ARE NOT LIMITED TO:
Smoking in the beach house – a $500 cleaning fee will be charged.
Room degradation (such as vomit, bodily wastes) – a $500 cleaning fee will be charged.
A $25.00 fee per key applies if a key is damaged.
Additional charges apply if a locksmith is required to change the locks as a result of lost or misplaced keys.

DAMAGE TO MATTRESS AND BEDDING:
Damage to mattress and linen, including; towels, mattress protectors, sheets, bedspreads, blankets, coverlets resulting from urine, vomit/bodily wastes and/or the use of body oils, make-up, shoe-polish, etc, will result in a charge for the special cleaning, repair or replacement of the damaged article.

HOUSEKEEPING:
A housekeeping service is provided after the eighth day of your stay (or then practicable) between the hours of 9am to 4 pm. We will attempt to pre-inform you of a housekeeping visit. If the beach house is un-occupied our housekeeper(s) will enter the beach house to perform a change of sheets and will perform general cleaning. Housekeeping staff will are advised not to disturb and to clean around personal belongings.

LINEN CHANGING:
If housekeeping is unable to change a bed due to personal items left on a bed for example, fresh linen will be left.

PARKING AT OWN RISK:
Each beach house has one parking space. All vehicles are parked at the risk of the owner of the vehicle. Mobys Beachside Retreat shall not assume liability or responsibility for any vehicle, occupants, or contents while operated or parked on the resort property. If a vehicle is left by a guest at Mobys Beachside outside the guests travel dates, management reserves the right to have the vehicle towed at the owner’s expense.

SECURITY CAMERAS:
CCTV is used in some areas of the resort

PETS:
With the exception of Registered guide dogs and registered assistance animals, guests are not permitted to bring pets into the resort. Any guests breaching this rule may face immediate eviction without refund and a $200 cleaning fee may be applied. Registered animals must be disclosed at the time of booking and proof of certification must be provided

BIKES, SCOOTERS & HOVERBOARDS:
To keep things safe and fun for all of our guests, we’ve updated our policy on electric devices.
What’s off limits:

  • Full-throttle electric bikes that don’t require pedalling
  • Electric scooters
  • Hoverboards
  • Segways
  • Charging lithium-ion batteries for these devices on the property

What’s still rolling:

  • Pedal-assist electric bikes that give you a boost only when you’re pedalling.

of course, your regular non-electric bikes, scooters and skateboards are always welcome! All riders are asked to abide by our 10km/h shared zone speed limit and parents are reminded to supervise children.

SMOKING:
Smoking and using e-cigarettes is prohibited inside any of the beach houses.
Under NSW law Smoking and using e-cigarettes are banned:

  • Within 10 meters of the swimming pool area, children’s outdoor playground equipment and the restaurant/function centre.
  • Within 4 meters of the pedestrian access point to reception

FIRE SAFETY POLICY:
The beach houses are equipped with smoke detectors, fire extinguisher and fire blanket. Emergency evacuation plans are located in each beach house. Please take the time to review this important information. NO CANDLES OR OPEN FLAMES PERMITTED INSIDE. Fire pits, or coal/wood fired bbq’s/heaters are prohibited within the resort. Smoking is also prohibited inside the beach houses

IN CASE OF EMERGENCY OR FIRE:
in the event of a fire or other emergency. Please call 000 then notify reception and or management either in person or by phone on 6591 0000 if safe to so. A map identifying the location of our emergency assembly point is located in your beach house.

LOST AND FOUND POLICY:
Mobys Beachside Retreat assumes no liability for lost, misplaced, stolen or damaged valuables or belongings. If you discover that you have left something behind of value to you, please call us immediately on 02 6591 0000 and we will try to assist you in locating your lost item.

FOUND ITEMS:
Mobys Beachside Retreat is not responsible for any item left behind by a guest. However any item (with the exception of perishable items) left behind by our guests and found after departure by housekeeping will be collected, logged in, and kept in a secure location for collection for up to thirty (30) days. Reasonable effort will be made to notify the guest that an item has been found. Perishable items, underwear and miscellaneous toiletries will be discarded. Mobys is not responsible for the safekeeping of any guest property whilst in our possession.

FACILITIES:
Mobys cannot be held liable for omissions or errors whether temporary or permanent of the property’s facilities and services. Photos shown on the website are indicative only and may not specifically represent the exact room allocated to you. Destination images featured on the Mobys website may not represent the views offered from our location. Accommodation facilities listed may not apply to all room types.

RESTAURANT/FUNCTION CENTRE:
The Restaurant & function centre is independently owned and managed. Trading hours and menus are subject to change at short notice without our knowledge. The restaurant & function centre will have their own terms and conditions which guests are to abide by.

FREE WIFI ACCESS:
Mobys offers free Wi-fi for guests around the swimming pool deck and in each beach house. Whilst we endeavour to provide fast and free wifi at all times during your stay Mobys retreat cannot guarantee the upload and download speed and is not responsible and/or outages that may occur beyond our control. The wifi is provided on an unsecured shared network. Mobys provides no guarantee of security whilst you are connected to our network and is not responsible for any damage etc. that may occur to any electronic hardware or software whilst connected to our wifi

PHONE RECEPTION IN PACIFIC PALMS:
Telstra offers the best coverage in our area. Optus coverage can be limited at times and Vodafone does not work near the resort. Mobys Retreat is not responsible for any network outages during your stay.

RIGHT TO REFUSE SERVICE:
We reserve the right to refuse service to anyone for any reason(s) that does not violate federal or state laws. The Mobys Beachside Retreat has a zero tolerance policy in which we will refuse to admit or refuse service or accommodation in our resort or may remove a person, without refund, who refuses to abide by the reasonable standards and policies established by the owners for the operation and management of the resort. Mobys Beachside Retreat will refuse service or evict a guest who is under the influence of illegal drugs or any other intoxicating substance and acts in a disorderly fashion as to disturb the peace of other guests., is unable to properly supervise their children at all times, seeks to use the resort for unlawful purposes, seeks to bring into the resort an unlawfully possessed firearm, fire-works or something, including an explosive, hazardous or toxic substance, that is unlawful to possess and that may be dangerous to other persons, destroys, damages, defaces, or threatens harm to resort property or guests, causes or permits persons to exceed the maximum allowable occupancy of room, refuses to abide by the reasonable standards or policies established by Mobys Beachside Retreat for the operation and management of our resort.

RELOCATION:
In the event of a situation whereby Mobys Beachside Retreat cannot provide accommodation as previously confirmed for whatever reason, management will attempt to contact the guest as soon as possible and will undertake to relocate guests to a comparable alternate property Should the guest not wish to accept the relocation a full refund & booking cancellation may be granted. If no alternative accommodation in the area is available management will provide a full refund.

MAINTENANCE:
In the interest of guest safety Mobys management reserves the right the cancel guest accommodation at short notice or move a guest out of their accommodation if an unforeseen safety or maintenance issue should arise.
In the event of any maintenance issues management and staff will make it a priority to rectify any reported issues in a timely manner. If a maintenance issue cannot be rectified in a timely manner we will offer a substitute room of equal value subject to availability

EPIDEMICS & PANDEMICS:
Mobys Beachside Retreat will follow all advice from the NSW or Australian Government regarding pandemics and epidemics
Mobys will comply with all government health orders and protocols as they change, and guests will be required to follow any measures that are in place at the time of travel.
Mobys will attempt to keep all guests up to date with changes as they happen as quickly and efficiently as we can.

LIMITATION OF LIABILITY:
Not with standing anything contained in these terms and conditions to the contrary, Mobys Beachside Retreat and its affiliates shall not be responsible for indirect damage, damage arising from consequential damage or special circumstances, including but not limited to loss of revenue, loss of profit, loss of use, loss of opportunity, arisen out of the performance or non- performance of obligations under this terms and conditions.

INSURANCE:
Mobys Beachside Retreat strongly recommends you purchase comprehensive travel insurance. We suggest that the policy include, but not limited to, the following coverage – loss of payment through cancellation, loss or damage to personal baggage, loss of money and medical expenses.

LEGAL STATEMENT:
Mobys Beachside Retreat has a strict policy for handling guest information. The information you provide to Mobys Beachside Retreat, is confidential and protected to the fullest extent possible. Mobys Beachside Retreat will not disclose or distribute guest information to third parties without prior written consent by the guest or in the situation where we are required to by law.
